Question: My company Executive Assistant/HR

Question: My company Executive Assistant/HR Administrator (no certification, no degree, no experience) sent a termination email for me to me and a co-worker, ran an add for my position on craigslist and printed my termination paper and left them on the printer (co-work gave it to me because it had my name on it. I''m a contract employee. The company has employees who are paid through ADP, self appointed HR Administrator contacted them on options for terminating me instead of the U. S. Labor Board. My confidentiality has been breached by the CEO and Executive Assistant/HR Administrator by sending email to co worker. I was harassed because the Executive Assistant/HR Administrator left the ADP Termination form was left on the printer/copier for hours. My position has been advertised as a part time administrative position. What are my options. The Executive Assistant/HR Administrator has business cards printed with the title and is not a member of any association. I have no affiliation with ADP, which advised them of there options. ADP does not represent Independent Contractor for Ramprate. What are my options. What is the penalty for miss representation of a HR Administrator. ADP advising on Independent Contractors they do not represent. The company is in violation. Again what are my options?

Hello, I know you are upset with how this has been handle. First the H/R person is being negligent as well as incompetent how she is handling the confidential paperwork that has been entrusted with her. However, in order to hold that job she does not have be a member of SHM or anyother H/R association. It may benefit her but anyone who can breath may land in H/R. But when they start getting the employer sued then the employer will then recruit and hire a qualified person with a degree and all certification to perform in the role. This is what gives H/R a bad reputation because employers give general titles to incompetent people without the education and skills to perform the job.

I am confused why the US Labor Brd would terminate your contract. The employer has a right to end the contract at anytime unless they have some language that prevents your termination. ADP is only a payroll processing company unless they have a larger contract with your employer. It appears she was giving them notice that you were no longer employed and to remove you from the payroll. But she was doing this that impacted you.

The H/R person is incompetent but it will limited on what you can do legally with her, she has breached your data, but how far you can go with that without damages, I would not think too far. For example if she had caused you to not get a job or someother damage you may pursue. But you are retaining an attorney , see what he/she says in being able to pursue. In my opinion you will be limited.You may want to write the CEO regarding her behavior and discuss her lack of H/R knowledge. I hope this has helped if so click accept.
