my son got hurt at work, compensation denied his claim, the same company handles disability payments,he was also denied disability, is this legal? We all pay for disability insurance, how can they deny it? He lives in Illinois, please answer, it is urgent, Thank you

kopikat, Workers'Compensation is reviewed and decided base upon many factors.One was the injury in the scope of the job performance.Is the employee's injury a direct cause from work. Once the insurance review the WC claim they can accept or turn the claim down, but you should be able to appeal the decision with additional information.

Your disability claim would be some what different, the question there are you able to perform the essential job functions and if you can perform those essential function then you most likely will be turned down for benefits. Again you should have a right to appeal but you would need medical documentation to support such claim, where as the WC claim is tied to work but the disability claim is not but must show you not only can work but you can not do the essentials of the job fubction. I know this is hurtful to have your son denied both but at least you know that you can appeal both. I hope this has helped and if so click accept. Take Care
