I have a labor law case and it was filed in Los Angeles ...

I have a labor law case and it was filed in Los Angeles Superior Court in June of 07. My case was taken on contingency. This is regarding me and my employer. We have already gone through the discovery process and both parties have already met with the Judge regarding the status of the case. This is not a class action case. If they offer a settlement, how long does this process take? Once they decide to settle out of court, do they have a whole year to settle,or do they have to settle within a certain time frame. By the way this involves overtime, meals and breaks.

The terms of any settlement are negotiable between the parties. They can agree on a time frame for the terms and obligations to be performed as they choose. When you mentioned "It is rare that this occurs in less than 6 months", do you mean 6 months from the day it was originally filed in court or from the day that the actual settlement is agreed upon.

They have already talked about possible settlement, so if all of the parties agree upon the amount, then approximately how long would it be before settlement is complete. Would it be 1 month or 6 months?
