They are only entitled to receive payment that has been earned. Any unpaid vacation time or sick time should be included as that has also been earned. So if the employee has earned the two weeks pay, that payment should be paid on the last day of employment or no later than the end of that week.

Is there a statute? This employee is stating "by the Missouri labor law, I am entitled to 2 weeks pay since I gave notice in writing". I would like to show something to him stating that he is incorrect.

Reply to Lawyer, Broker 's Post: Sorry, I was not clear here.
We had an employee who gave 2 weeks notice. My father told him to leave immediately. He received his final paycheck at the regularly scheduled pay period. He called yesterday and stated "by Missouri labor law" he was entitled to receive two more weeks pay since he gave 2 weeks written notice.

We would like to be able to respond "according to the _____________", he is incorrect in thinking that he is owed an additional 2 weeks pay because of the 2 weeks notice in writing.
