After 8 years as a security guard at an industrial site, the site contracted with a different security company. I was 1 of 5 guards out of 25 the new security company did not hire. After recieving several awards and certificates for professionalism the last eight years, my job performance is not an issue, however the new security company will not give any reason for not hiring me. I suspect it is my age. I will turn 59 soon. My original security company is advising me to file for unemployment as they have no current positions available. What legal or civil rights recourse is available to me?

If you were at "at-will" employee for this company then you can be fired for any reason or no reason so long as the basis for termination was not based on a violation of the Equal Employment Opportunity Commission (here).

If you are claiming age discrimination you need to show evidence that it was age related. If the other 4 employees who were not hired were also in the same age range as you, then it might be possible that age could have been a factor. In such case then I would encourage you to file a charge with the EEOC here for further investigation. You are required to first file with the EEOC before you file a lawsuit. They will investigate to see if your claims are warranted. You should also speak with an employment law attorney to further represent your interests.

If the main issue for not hiring you is because there are no current positions available then this will not be considered discrimination.
